Sunak’s promise to ‘stop the boats’ is a gift to Nigel Farage – because it’s doomed to fail
As Tory MPs headed off for their half-term break this week, they were reassured that they will soon finally get what some have been demanding for years: “tough” new laws to tackle Channel migrant crossings.
In a pep talk to the 1922 Committee of backbenchers, Home Secretary Suella Braverman made plain that the new “stop the boats” legislation would indeed be published when Parliament returns.
After a bruising first few weeks in office, Rishi Sunak certainly wants to be seen as a man of action on the whole topic of asylum and illegal immigration. The issue was one of his five New Year priorities for 2023, and the “stop the boats” slogan has been plastered prominently behind him at every “PM Connect” event he’s staged since.
At first, the small print of Sunak’s immigration pledge seemed to set the relatively easy task of just getting fresh legislation passed. “We will pass new laws to stop small boats”, it said. Yet through accident or design, this has now morphed into a concrete pledge to actually halt the crossings.
Unfortunately, it’s a lot easier to get a bill through Parliament than it is to stem the flow of dinghies from the French coast.
We’ve been here before, of course. It was Priti Patel who as Home Secretary made a similarly foolish pledge in November 2021 to “prevent 100 per cent of crossings”. That was a doubling down of her promise on taking office in 2019 to halve the crossings within three months.
Spoiler alert: Patel didn’t hit her target. In fact, the numbers have soared a hundredfold in the last three years. Latest figures show that more than 45,000 people crossed the Channel in small boats in 2022, up 60 per cent on the year before, which was itself a record high.
With Border Force insiders forecasting the total may go up to 80,000 crossings in 2023, it’s unlikely ministers will be able to claim a reduction in numbers – let alone “stopping” them completely.
Still, Sunak clearly hopes the forthcoming legislation will have an impact. It is expected to place a legal duty on the Home Office to deport migrants who arrive illegally or enter the UK indirectly through a safe third country without permission.
Overall, Tory MPs hope the legislation will make it easier to implement the Government’s plan to deport asylum seekers to Rwanda processing centres, without getting overturned in either the British courts or the European Court of Human Rights.
But even if the policy gets through the courts, there is little evidence to show that either a tougher legal process or the Rwanda plan will actually deter people from making the Channel crossing in the first place.
For many Tory MPs the real issue is the increased number of asylum seekers now staying in hotels and other temporary accommodation in their constituencies.
What really would have more impact on refugee numbers would be clearing the huge backlog in asylum applications that have built up in recent years. One of the most startling statistics of last year was that the Home Office only processed four per cent of the claims of 2021 Channel crossers.
Recent analysis by the Refugee Council concluded that at least 60 per cent of the men, women and children who risked the dangerous crossing last year would be given refugee status.
If the claims processing system were speeded up, that would help all those genuine refugees on the path to becoming wage-earners and contributors to British society, while allowing faster deportation of those who were deemed economic migrants.
To be fair, Sunak has made another more practical pledge on this very issue, promising that he would clear by the end of 2023 the backlog of claims made up to last July.
Immigration minister Robert Jenrick claimed this week that there had already been “excellent progress” in recruiting more caseworkers, establishing dedicated teams “per nationality” and designing a more streamlined process, “which is already raising productivity substantially”. That, plus closer working with French police, could be more effective than any new legislation.
Yet ultimately, the key to reducing Channel crossings may lie in providing safer, legal routes to asylum in the UK. Four in 10 of those risking the route are from Afghanistan, Iran, Syria, Sudan and Eritrea. Campaigners point out that safe route numbers are 75 per cent down on pre-pandemic rates, and family reunion visas have fallen by 36 per cent.
The Ukraine refugee scheme has shown how the UK can act humanely, and the opening of our borders to British nationals from Hong Kong has been a huge success, injecting entrepreneurship and talent into our economy. As I’ve written before, another key reform would be to let more asylum seekers work in the UK while waiting for their claim to be settled.
It’s true that migration is driven by complex forces, but when desperate people with family or other ties to the UK are denied legal routes, it’s perhaps no surprise they resort to illegal entry. Creating safe routes would hit the people’s smugglers’ callous business model, and reduce the risks of yet more tragedies in the sea this year.
There’s some chatter in Whitehall that Sunak actually does plan to expand legal routes later this year, but feels he will only have the political space to do so if he gets his tough legislation out first. As he runs out of time to get the boat numbers down, that may prove to be a strategic blunder.
More broadly, Sunak’s big political error feels like a repeat of David Cameron’s pledge to get net migration below 100,000 a year. That was a millstone that hung round his Government’s neck, and it’s arguable that his failure to meet it helped fuel the rise of Nigel Farage, and in turn Brexit itself.
The promise to halt Channel crossings could be even more risky than Cameron’s, with Farage’s Reform party just itching to seize on rising numbers to take a bite out of Tory support at the next election. Instead of quietly getting on with a pragmatic approach, his promise will shine a spotlight of blame on his Government on the issue of immigration itself.
Sunak may already be riding for a fall on his other New Year pledge to cut NHS waiting lists this year. But by repeatedly promising, and then failing, to “stop the boats”, he may stop the votes the Tories need to stay in power.
